1. Introduction and Acceptance

• These Terms and Conditions (the “Agreement”) govern all access to and use of the services offered under the HoaVPN brand, including VPN or v2ray subscriptions, related digital products, and any content, features, or resources provided through our website or associated domains (collectively, the “Services”).
• In this Agreement, (“HoaVPN,” “we,” “us,” or “our”) refers to the operator and provider of the Services. The terms (“User,” “you,” or “your”) refer to any individual or entity that accesses, browses, registers an account, purchases a subscription, or otherwise uses the Services.
• By visiting our website, upon creating an account, or using any part of the Services, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. All Users and visitors are required to fully comply with these Terms as a condition of accessing or using the Services.

2. Account & Membership

• You agree that you are at least 13 years old (or of legal majority in your jurisdiction) when using the Service.

• Upon subscription, we grant you a semi-exclusive, non-transferable, personal license to use the VPN / v2ray configuration for your own lawful purposes.

• You may use the Service on up to five (5) devices simultaneously (unless you notify us or we mention a different limit). Sharing your account credentials with third parties or transferring your access is prohibited.

3. Subscription Plans, Payment & Refunds

• We offer various subscription plans: one-time, monthly, 2-month, quarterly, half-year, yearly — and occasionally gift subscriptions or discount codes.

• Payments are processed via third-party payment gateways (e.g. cryptocurrency — USDT, TRX, XRP — and other accepted methods such as Alipay, WeChat). We do not store or control your payment data.

• Refund policy: If within 14 days of purchase, you have used no more than 10% of allocated traffic (or 2 GB) and you claim that traffic was unusable, you may request a refund — in which case we will refund to your original cryptocurrency wallet (USDT, TRX, or XRP). No refunds are available otherwise. Gift subscriptions or purchases using discount codes are non-refundable unless explicitly stated.

• We may offer prorated refunds (or service extension) in cases of major service unavailability at our discretion (see Section 7).

4. Acceptable Use; Prohibited Activities

You agree not to use the Services for any unlawful or prohibited purposes. Prohibited uses include (but are not limited to):

• Engaging in or facilitating illegal activities (hacking, fraud, identity theft, terrorism, child abuse, etc.).

• Uploading, downloading, distributing, or accessing content that infringes copyright or other intellectual property rights.

• Distributing spam, unsolicited bulk email/messages, or malicious software (malware, viruses, trojans).

• Using the Service to host or distribute pornography, or content involving minors.

• Attempting to interfere with or disrupt our servers, networks, or other users.

• Reselling or redistributing the Service (unless you have explicit written permission for “reseller/white-label” use).

We reserve the right to suspend or terminate your account immediately for violations, without refund.

5. Privacy & Logging Policy

• We maintain a strict no-logs policy regarding your browsing activity: we do not store or log connection timestamps, IP addresses, DNS queries, or the details of your online activity.

• We collect only minimal data necessary for account management (e.g. your email) and payment processing. Payment gateways are third-party and not controlled by us.

• You agree that usage statistics (e.g. how much traffic you consumed) may be aggregated in anonymized form for our internal monitoring and reporting, but will not be tied to your identity.

6. Service Availability, Uptime & Warranty Disclaimer

• We aim to provide stable and reliable service, but we do not guarantee uninterrupted service, error-free operation, or that the Service meets your expectations. Temporary disruptions may occur due to maintenance, external network conditions, or state-level internet restrictions.

• We reserve the right to change, modify, suspend, or discontinue any aspect of the Service (including server locations or configurations) at any time without prior notice.

• The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including fitness for a particular purpose, merchantability, or non-infringement.

7. Support, Extensions & Refund Handling

• Support is provided via a ticketing system in your user panel, live chat, or a Telegram channel. Response times may vary — from a few minutes to up to 24 hours depending on the channel and issue severity.

• If you experience technical issues — you must contact support first. if the problem is due to our service and cannot be resolved in short term, We may offer a prorated refund or an extension of your subscription (at our discretion).

• Refund requests under the “Refund Policy” (Section 3) must be submitted within 14 days and meet the traffic-usage limitation stated.

8. Termination & Suspension

• We reserve the right to suspend or terminate your account at any time, with or without notice, if we determine (in our sole discretion) that you have violated these Terms or engaged in prohibited activity.

• Termination for cause (e.g. abuse, illegal use) is immediate and final; no refund will be provided in this case.

• You may cancel your subscription at any time. Cancellation does not automatically entitle you to a refund (see Section 3).

9. Reseller / White-Label Permissions

• Reselling, sub-licensing, or redistribution of the Service is permitted only if explicitly approved by us. Unauthorized reselling or distribution is prohibited and may result in immediate termination.

10. Indemnification & Limitation of Liability

• You agree to indemnify and hold us harmless from any claim, damage, liability or loss arising from your use of the Service (including violation of laws or third-party rights).

• To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential damages (including loss of profit, loss of data) arising from your use or inability to use the Service, even if we were advised of the possibility of such damages.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws applicable in The Bahamas (i.e. “applicable law”). You agree that any dispute will be resolved by amicable efforts; in case of failure, you may only claim compensation in the form of service extension or refund (if eligible under Section 3), and you waive rights to class-action or collective proceedings.

12. Changes to Terms

• We reserve the right to modify these Terms at any time. The updated version will be posted on our website. Continued use of the Service after changes implies acceptance of the new Terms.
